These Terms and Conditions apply to purchases made through the Fruto Farmers website by private customers and, where applicable, professional customers.
Separate or additional commercial conditions may apply to Office Fruit Delivery, HORECA supply agreements, recurring deliveries and individually negotiated professional orders.
3. Products
Fruto Farmers offers fresh and seasonal produce and other selected food products, including citrus fruits, avocados, fruit boxes, olive oil, rice, quinoa and other products that may be incorporated into the catalogue.
As many of our products are agricultural products, their appearance, size, shape, colour, ripeness and other natural characteristics may vary.
Product photographs are intended to represent the products as accurately as possible, but natural variations do not necessarily constitute a defect.
4. Availability
Product availability may depend on seasonality, harvest conditions, agricultural production, stock and supply.
If a product becomes unavailable after an order has been placed, we will contact the customer to offer an appropriate alternative, refund or other reasonable solution.
5. Prices
Prices are displayed in euros unless otherwise indicated.
Applicable taxes will be included or clearly shown in accordance with applicable legislation.
Delivery charges, where applicable, will be shown before the customer confirms the order.
6. Orders
Customers must provide accurate and complete information when placing an order, including the information required for invoicing, payment and delivery.
After completing the purchase process, the customer will receive confirmation of the order through the contact details provided.
Fruto Farmers reserves the right to contact the customer if clarification is required before an order can be processed.
7. Payment

Payment must be authorised before the order can be processed unless different payment conditions have been expressly agreed with a professional customer.

8. Delivery

Fresh and seasonal products may occasionally be affected by weather conditions, harvest circumstances, transport incidents or other factors outside our reasonable control.
9. Receipt of the order

Fresh products should be unpacked and stored appropriately after receipt.
If an order arrives damaged, incomplete or incorrect, the customer should contact Fruto Farmers as soon as possible.
10. Fresh and perishable products
Certain Fruto Farmers products are fresh foods that may deteriorate or expire rapidly.
Under applicable consumer legislation, the standard right of withdrawal may not apply to goods that are liable to deteriorate or expire rapidly.
This exception does not affect the customer’s statutory rights when a product is defective, damaged, incorrectly supplied or otherwise does not conform to the purchase agreement.
11. Non-perishable products
Where products are not rapidly perishable, any statutory withdrawal rights applicable under Spanish and European Union consumer legislation remain unaffected.
Certain exceptions may apply to opened or unsealed food products where hygiene, health protection or product integrity considerations apply.
12. Cancellations
Customers should request any order cancellation or modification as soon as possible.
Where possible, requests submitted within 8 hours after placing an order will be considered before preparation or dispatch begins.
Because fresh products may be prepared shortly after the order is received, cancellation may no longer be possible once preparation or dispatch has started.
13. Refunds and replacements
Where a product is damaged, defective, incorrectly supplied or affected by a verified quality problem, Fruto Farmers may provide an appropriate remedy.
This may include:
- Replacement of the affected product.
- A partial refund.
- A full refund where appropriate.
- Another solution agreed with the customer.

14. Office Fruit Delivery and HORECA
Fruto Farmers also provides professional supply services for offices, restaurants, hotels, cafés, caterers and other businesses.
These services may involve recurring deliveries, specific product selections, agreed quantities, different payment conditions or individually agreed delivery schedules.
Where specific contractual conditions have been agreed with a professional customer, those conditions will apply alongside these general terms.
15. Intellectual property
The content of this website, including its texts, photographs, graphics, logos, trademarks, product descriptions and design elements, belongs to MPELTFRUIT SL. or is used with the appropriate authorisation unless otherwise stated.
Such content may not be reproduced, distributed or commercially exploited without authorisation except where permitted by law.
16. Personal data
Personal data is processed in accordance with our Privacy Policy and applicable data protection legislation, including Regulation (EU) 2016/679 (GDPR).
17. Liability
Nothing in these Terms and Conditions excludes or restricts liability where such exclusion or restriction would be prohibited by applicable law.

18. Applicable law
These Terms and Conditions are governed by Spanish law, without prejudice to any mandatory consumer protection provisions applicable under European Union legislation or the law of the consumer’s country of residence where applicable.
Any dispute will be submitted to the courts or authorities having jurisdiction under applicable legislation.
